Judicial Panel to Reconsider Decision That Allowed Trump to Deploy Military Forces to Portland

The ninth circuit court has maintained a ban on deploying national guard in Portland, Oregon, following a recent legal decision.

Appeals Court Concurs to Reconsider Case

The federal appeals court ruled on Tuesday that it would reexamine the legal dispute concerning the executive power with an larger group of 11 judges. The court also overturned a previous decision from a smaller judicial group that had sided with the administration.

Ongoing Dispute Over Military Presence

This order represents the most recent development in a long-running court case over whether the administration has the authority and justification to deploy state military units in the city. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was initiated in due to ongoing demonstrations.

Differing Viewpoints

The administration has claimed that government employees at the ICE facility in the southern part of the city were under attack, while city and state officials maintain that municipal police have command of the circumstances.

In defiance of descriptions of Portland as a conflict zone, residents have been sharing videos of scenic paths and a vibrant culinary culture, and planning activities such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a federal judge in Portland issued two temporary restraining orders this month – one preventing the federalization of the state troops, and another stopping the use of any national guard troops in Oregon, after attempts to circumvent the first order by calling up troops from California.

On the previous day, the ninth circuit panel had put the first ruling on hold – permitting control of state troops – but the second ruling stayed effective, preventing the physical sending of the forces.

The Tuesday decision means the matter will be heard by the full court – with all decisions under consideration simultaneously – by a group of 11 judges.

“This decision demonstrates that the truth matters and that the courts are working to ensure government responsibility. The constitution restricts the executive authority, and Oregon’s communities cannot be treated as a training ground for expansive government power,” said the state attorney general in a statement.

“The judicial body is sending a definite signal: the executive leader cannot dispatch the military into US cities unnecessarily. We will continue defending Oregon’s laws, values, and autonomy as this case moves forward and our fight continues in the courts.”
